Ticket Terms and Conditions
By purchasing or using a ticket to any University of Texas Rio Grande Valley Athletics Department (“UTRGV”) ticketed event (“Event”), Guest (defined below), on Guest’s behalf and on behalf of any minor accompanying Guest, agrees to the following terms and conditions as may be amended by UTRGV from time to time:
- The ticket purchaser/holder, on behalf of the holder and any accompanying minor of the purchaser/holder, including a minor holding a separate ticket (individually and collectively the “Guest”), voluntarily assumes all risk of property loss and personal injury arising during the ticket’s use, during the Event for which the ticket is issued, or during activities on UTRGV-owned or leased property occurring before, during, or after the Event (either inside or outside the venue). UTRGV will not be responsible for lost, stolen, or damaged property.
- In using the ticket, Guest releases UTRGV, participating student-athletes, coaches and staff, the Event venue, television or radio broadcasters, sponsors, vendors, and each of their respective affiliates, employees, and agents, and all volunteers (collectively, the “Released Parties”) from any and all liabilities arising out of or related to the Event and any such communicable diseases, injuries, illness, death, or property damage. By attending the Event, Guest, on behalf of Guest and Related Persons (defined below), is deemed to have given a full release of liability to the Released Parties to the fullest extent permitted by law from any claims which Guest and any of Guest’s Related Persons may have for causes of action arising out of attendance at, observation of, or presence within or around the Event.
- “Related Persons” means the Guest’s heirs, assigns, executors, administrators, next of kin, anyone attending the Event with Guest (which persons the Guest represents have authorized Guest to act on their behalf for purposes of the releases herein), and other persons acting or purporting to act on the Guest’s or their behalf.
- The ticket is a revocable license. In UTRGV’s sole discretion the ticket may be revoked and Guest ejected or refused admission without refund for violation of these terms and conditions, Event ticket and venue policies, illegal activity, violation of UTRGV or University of Texas System rules or policies, violation of the Guest Code of Conduct, or any conduct deemed by UTRGV to be disorderly, unruly, or dangerous. Any Guest interfering with the play of the contest or engaging in disruptive behavior, including without limitation throwing items onto the playing surface, may be subject to ejection from the Event. Guest may not solicit contributions or distribute literature on the premises, unless expressly authorized by the UTRGV Athletics Department.
- Guest may only capture any account, description, video, audio, photograph, scoring-related data or statistic (“Content”) of, from, or at the Event on any day of the Event throughout the Event site (including, for clarity, competition areas on competition days, consisted with the rules and instructions of UTRGV and its Athletics Department. Guest, however, may not capture, transmit, distribute, or otherwise use Content for any purpose other than personal, non-commercial purposes (e.g., for a personal social-media account), and Guest may not distribute such Content on a live or near-live basis (e.g., no live streaming) or use such Content to create a real-time account of the Event. Further, Guest may not use or authorize others to use any such Content for any commercial or promotional purpose, or for or in connection with a media outlet (directly or indirectly) unless Guest and the media outlet have received an official media credential from the UTRGV Athletics Department. Guest may not collect, transmit, distribute, publish, or sell Content (including any scoring, statistical, competition, or other data from the Event) for purposes of any betting or gambling activity. UTRGV is the sole owner of, and Guest hereby assigns to UTRGV, all right, title and interest in and to all Content, including all copyrights and rights to use all Content (including rights to use Guest’s social-media post(s) incorporating the Content), subject to Guest’s permission from UTRGV to capture and distribute certain Content on the limited terms set for in this license. Upon reasonable request from UTRGV, at UTRGV’s cost and expense, Guest agrees to sign any documents necessary to affect UTRGV’s ownership and use of Content.
- Guest expressly grants UTRGV, its affiliates, licensees, and their assigns the right to use Guest’s image, likeness, voice, actions, or statements (and that of any minor accompanying Guest) in connection with any live or recorded video display, broadcast or other transmission, reproduction, or other depiction of the Event or related events to which this ticket admits the Guest, for any purpose (including promotional purposes), in any and all media now known or hereafter developed, without further authorization or consideration.
- Unless specifically authorized in writing in advance by the UTRGV Athletics Department, the ticket may not be used in or for advertising, offered in a commercial promotion, or offered as a prize in a contest, sweepstake, or giveaway. Individuals selling or reselling tickets in violation of any applicable city, county, or state regulations, laws, or ordinances may be subject to arrest and prosecution. UTRGV reserves the right to deny entry to any individual who obtains the ticket through unapproved advertising, promotion, giveaway or other commercial purpose, and a Guest violating this policy may face sanctions including (without limitation) loss of future ticket privileges.
- The ticket may not be duplicated. Tickets obtained from sources other than an agent of UTRGV may be lost, stolen or counterfeit, and in such cases, will not be honored. The ticket may not be replaced if lost, destroyed, or stolen, nor the price refunded.
- By presenting the ticket for entry to the Event, Guest (1) consents to all searches of person or property/belongings as a condition of entry, (2) consents to the confiscation of prohibited items, and (3) waives any related claims Guest might have against UTRGV, The University of Texas System and their employees, agents, affiliates, or contractors. If Guest chooses not to consent to searches, confiscation of items, or waiver of related claims, Guest will be denied entry to the Event.
- UTRGV may choose to relocate the Event to another facility, with or without notice, and without liability to Guest.
- UTRGV will not be responsible for punitive, incidental, consequential, or special damages. Guest agrees not to take any action, or cause others to take any action, which would infringe upon UTRGV’s rights.
If Guest does not wish to accept these terms or does not wish to grant the rights, releases, or waivers described above to UTRGV, Guest should immediately leave the Event.
Re-Entry Policy
The UTRGV Athletics Department allows re-entry at all of its events so long as the Guest presents their ticket to a Game Day Employee upon exiting and re-entry. Any Guest who fails to show a ticket will not be granted re-entry.
Current UTRGV students must present their UTRGV student ID and their digital student upon exiting and re-entry.
Any Guest or student who presents a ticket that was previously scanned into the venue but not scanned out of the venue will not be granted re-entry.
Guest Code of Conduct
UTRGV Athletics values sportsmanship and is committed to providing a safe environment for all individuals employed by or associated with UTRGV, including UTRGV staff members, student-athletes, coaches, and officials. UTRGV Athletics is also committed to creating a safe, enjoyable, and family-friendly for all fans free from disorderly behavior, including harassing other attendees and using obscene or abusive language or gestures. All individuals are expected to conduct themselves with good sportsmanship and therefore should exhibit respect and courtesy toward opposing student-athletes, coaches, and game officials. Any individual creating an unsafe environment, including coming onto or attempting to come onto the playing surface without UTRGV authorization, throwing items onto the playing surface or at any person, otherwise engaging in disorderly conduct, will be removed from the event.
To assist UTRGV Athletics in meeting these commitments to a safe and enjoyable environment for all fans, staff, student-athletes, coaches, and students, UTRGV Athletics asks all Guests to follow these guidelines:
- Support the Vaqueros in a positive manner while treating fans, teams, and officials with dignity and respect.
- Refrain from disruptive behavior, including fighting, using foul or abusive language or obscene gestures, or wearing inappropriate attire.
- Promote an environment that minimizes disruption, creates a safe atmosphere for all, prevents interference with the game and ensures the enjoyment of the game for everyone.
- Do not throw items at anyone or onto the playing surface or attempt to enter the playing surface – violators will be removed from the facility and may be subject to arrest.
- Be responsible when consuming alcohol beverages. Impairment, intoxication, underage consumption, or unruly behavior will be addressed in a prompt and safe manner by UTRGV Athletics staff or law enforcement.
- Sit only in the seat designated on the ticket and be prepared to show the ticket upon request.
- Refrain from smoking or using any tobacco products, including e-cigarettes and smokeless cigarettes or tobacco, anywhere on the property of UTRGV. Individuals who violate this rule will be subject to ejection from the facility.
- Follow all local, state, and federal laws, and UTRGV and University of Texas System rules and policies and follow the instructions of event staff and law enforcement.
- Comply with emergency messages, emergency procedures and requests from UTRGV Athletics staff concerning the facility and gameday operations.
Examples of prohibited behavior include (without limitation) throwing objects of any kind; attempting to climb on the goal posts, entering or attempting to enter the playing surface, or engaging in other types of disorderly behavior; engaging in behavior that endangers the safety of student-athletes, coaches, officials or other guests; or taunting event staff, student-athletes, coaches or training staff, referees or game officials, public safety officials, or any other person whose ability to perform game-related responsibilities could be impaired by such taunting.
UTRGV Athletics staff and law enforcement can intervene where necessary to help ensure the above expectations are met. Attendees are encouraged to report any inappropriate behavior to the nearest event-staff personnel.
Guests who exhibit disorderly behavior or otherwise violate ticket or venue policies or this Guest Code of Conduct may have their tickets revoked, may be ejected from the facility without a refund, or may be subject to arrest or prosecution. Students failing to meet these expectations or otherwise engage in disruptive behavior may be referred to Student Rights and Responsibilities for disciplinary action. UTRGV reserves the right to manage the facility, event, and conduct of attendees in a manner UTRGV, in its sole discretion, deems necessary or appropriate based on public safety concerns, operational or staffing considerations, or any other appropriate and lawful business reason.
Guests with obscene or indecent messages on signs or clothing, or who appear intoxicated will not be granted access to any UTRGV Athletics venue.
Clear Bag Policy
A clear bag policy is in effect to enhance existing security measures and expedite entry to the venue. Clear bags should be made of plastic, vinyl, or PVC and not exceed 12" x 6" x 12". Any plastic storage bags brought into the venue should be no larger than one gallon and must be both resealable and clear.
Exceptions
- Clutches, bags, purses, or wallets that are smaller than 4.5" x 6.5" do not need to be clear, but are subject to bag checks.
- Diaper and medically necessary bags do not need to be clear or meet size restrictions, but are subject to bag checks.
- Any adult bringing in a diaper bag must be accompanied by a child upon entry and the bag must contain childcare related items, e.g., diapers, wipes, changes of clothes, bottles for breast milk or formula, baby food, or similar items.
- Bags deemed to be medically necessary must be specifically necessary/required for medical equipment and accommodations that cannot fit within the small bag or clear bag sizing, e.g., an insulated bag with ice pack to keep medication chilled, oxygen tank carrier/bag, large bag to carry a lactation pump, and so forth.
- Medically related items that can safely be stored and transported in a small clear bag will not qualify for a larger medical bag exception and should be brought in a bag that meets the small bag or clear bag requirements. Examples of medical items that will not qualify for an exemption include, but are not limited to, medication that does not need to be refrigerated, pill bottles, epi-pens, or inhalers.
Prohibited Bags
Prohibited bags include non-clear bags that exceed 4.5” x 6.5” OR clear bags that exceed 12” x 6” x 12”. This includes items such as purses, camera/binocular cases, backpacks, fanny packs, printed pattern plastic bags, reusable grocery totes, tinted plastic bags, mesh or straw bags, duffle bags, large totes, or any other bags that event personnel deem do not meet the clear bag policy.
Bag Check
At any athletic event where alcoholic beverages are served, UTRGV Athletics will inspect all backpacks, purses, briefcases, and other bags upon entry in order to comply with all aforementioned rules and policies. Any Guest who refuses to have their bag inspected will not be granted access to the venue. Bag checks are conducted to prevent the following items from entering the venue:
- Outside food and beverages (including alcoholic beverages)
- Weapons
- Any other banned prohibited items as outlined in this policy
Weapons Prohibited
Excluding those carried by authorized law enforcement officers, no firearms or weapons are permitted on the premises of any UTRGV Athletics event. Under Sections 30.06 and 30.07,
Texas Penal Code, a person licensed under Subchapter H, Chapter 411,
Texas Government Code (Handgun Licensing Law) may not enter the property with a concealed handgun or a handgun that is carried openly. UTRGV Athletics does not provide weapons lockers. Weapons include, but are not limited to the following:
- Firearms
- Explosives
- Stun Guns
- Handcuffs
- Clubs
- Martial Arts instruments
- Tear Gas
- Knives
Guests found in possession of the above-mentioned items will be asked to remove the item from the venue or dispose of it. Guests who refuse to comply will be evicted from the venue and may be subject to arrest.
Additional Prohibited Items
- Outside food and beverages (including alcohol)
- Animals (excluding Service Animals)*
- Umbrellas
- Strollers
- Laser Pointers or any laser products of any type
- Fireworks
- Artificial Noise Makers (applies only to UTRGV Fieldhouse)
- Any other item deemed unacceptable by UTRGV Athletics. UTRGV Athletics will not store any of the aforementioned items.
Service Animal Policy
No pets or animals of any kind are permitted, with the exception of service animals used by guests with disabilities consistent with this policy. Under federal anti-discrimination law, Service Animals are dogs individually trained to do work or perform tasks for guests with disabilities, such as:
- Guiding people who are blind
- Alerting people who are deaf
- Pulling wheelchairs for those with limited mobility
- Alerting and protecting a person who is having a seizure
- Reminding a person with mental illness to take prescribed medications
- Calming a person with Post Traumatic Stress Disorder during an anxiety attack
- Performing other special tasks
Service Animals are working animals, not pets. The work or task a dog has been trained to provide must be directly related to an individual’s disability. Dogs whose sole function is to provide comfort or emotional support do not qualify as Service Animals.
A Service Animal must be harnessed, leashed, or tethered, unless these devices interfere with the Service Animal’s work or the guest’s disability prevents using these devices, in which case the guest must maintain control of the animal through voice, signal, or other effective controls. The guest will be responsible for cleaning up after and properly disposing of animal waste in a safe and sanitary manner and will be financially responsible for the actions of the Service Animal.
UTRGV may require the guest to remove the Service Animal from the event if the Service Animal is out of control and the guest does not take effective action to control it; the Service Animal is not housebroken; or the guest does not comply with the guest’s responsibilities under this policy. If a Service Animal is removed under this policy, UTRGV will work with the guest to determine reasonable alternative opportunities to allow the guest to attend the event without having the Service Animal on the premises.
Photo Policy
Only credentialed personnel are permitted to use professional cameras at UTRGV athletic events.
Guests are prohibited from bringing professional cameras, including any camera with detachable or interchangeable lenses, camera lenses wider than the camera body, or a fixed lens that is six inches or larger into UTRGV Athletics venues. Guests are also prohibited from bringing camera bags, tripods, monopods, and selfie sticks into UTRGV Athletics facilities.
Personal handheld cameras, including those inside phones, are permitted. However, in no instance may photography interfere with access ways, seats, aisles, or other Guests' enjoyment of the game. Additionally, flash photography is strictly prohibited.
Guests are prohibited from selling any photos taken at UTRGV Athletic events.
Baseball Tailgating Policies
UTRGV Athletics is excited to offer fans the opportunity to tailgate in Lot 33E behind the right-field wall at the UTRGV Baseball Stadium (the “Stadium”) six (6) hours before and during all home baseball games played in Edinburg. The following policies are designed to provide a safe and enjoyable environment for tailgating, to promote the security and safety of individuals associated with baseball game-day activities, and to safeguard and preserve property under the management of UTRGV. We ask that fans follow the policies below to ensure a safe and enjoyable tailgating experience for everyone.
General Conduct
- All tailgaters understand they are responsible for maintaining a safe, family-friendly atmosphere at their tailgating location.
- All guests are subject to federal, state, and local laws, as well as all UTRGV and University of Texas System rules and policies.
- UTRGV is a tobacco-free facility. No smoking is permitted either in the Stadium or in the designated tailgate area.
Food, Beverages, and Cooking/Grilling
- Food and beverages shall be for personal consumption only. Sales are prohibited.
- Live fire cooking equipment must be attended at all times and may not be left unattended.
- No fires may be built on the ground or in a dug pit in the grass areas.
- Fire extinguishers must accompany cooking or grilling appliances.
- The use of charcoal and propane is permitted in the tailgate area.
- Coals must be disposed of properly in designated containers.
- Glass containers are prohibited in the tailgate area.
- Alcohol may be consumed responsibly only by individuals 21 years of age or older and only within the tailgate area.
- Kegs of any size (e.g., any barrel size, pony kegs, or mini-kegs), wine casks or kegs, or other similar common-source containers are prohibited on campus and in the tailgate area. Beer funnels, bongs, or other similar devices are also prohibited.
- Food, drinks, and containers from the tailgate area or parking lots will not be permitted in the Stadium.
Amplified Music
- Tailgaters are expected to be respectful of the rights of others in their immediate area when listening to or playing music.
- Amplified music must be confined to individual tailgate areas and speakers must be directed into the individual tailgate area and away from the Stadium. All music must be turned off 20 minutes before game time.
- Amplified music containing abusive, indecent, profane, or vulgar language or containing obscenity will not be tolerated.
Utilities, Safety and Security of Tailgate and Parking Areas
- Hooking into, connecting to, or otherwise physically connecting to and using UTRGV utilities (including television or cable communication services) is prohibited.
- Individuals are responsible for properly securing all overhead objects, including flags, balloons, or any other similar objects. NOTE: UTRGV prohibits the use of drones on UTRGV property when conducting UTRGV-sponsored events, except as required by law or as expressly authorized under UTRGV Handbook of Operating Procedures Policy ADM 10-905 Unmanned Aerial Vehicles.
- It is the responsibility of each tailgate party to secure tailgating items before entering the Stadium.
- All trash from tailgates must be disposed of properly in designated containers.
- Tailgate items or equipment may not be left in the tailgate area overnight and must be removed after the game.
- No overnight camping is permitted.
- Saving individual parking spaces is prohibited. Guests must arrive together to have spaces near each other.
- Individuals may not erect or move barricades, barrels, fencing, or any other traffic control devices.
- All parking signs and instructions must be obeyed and strictly followed.
- Any personal use of all-terrain vehicles, golf carts, gators, scooters, mopeds, and other motorized recreational vehicles is prohibited.
Solicitation and Related Policies
- UTRGV generally does not permit unauthorized soliciting or collecting of contributions, vending, distribution of fliers or other promotional/advertising materials on UTRGV property.
- Tents, canopies, flags, and banners that contain corporate, business, or organization branding are not allowed, except for those that are official corporate partners of UTRGV Athletics.
Businesses and organizations are not permitted to promote, market, or advertise on Stadium grounds, including all tailgating and parking spaces, except for those that are official corporate partners of UTRGV Athletics. Those that violate this policy will be asked to remove branded items from their tailgate space or area.
- Signs, banners, flags, or similar items that, in the judgment of Athletics Department or other appropriate UTRGV personnel, contain obscene, defamatory, abusive, profane, vulgar, or harassing images or language may not be displayed in the tailgate area.
- Signs, banners, flags, wraps, or other similar items regarding political candidates or issues may not be displayed in the tailgate area.
- Electioneering is not permitted in the tailgate area. Political campaigns and individuals running for public office are required to follow UTRGV Handbook of Operating Procedures Policy ADM 02-300 Speech, Expression, and Assembly and UTRGV Campus Political Activity Guidance (https://www.utrgv.edu/gcr/_files/documents/gov/utrgv-campus-political-activity-guidance.pdf) with respect to political activity on UTRGV property.
Restrooms, Pets, and Non-Compliance with Tailgate Policies
- Restroom access will be available in or near the tailgate area.
- Household pets must be on a leash. Except for a “bark in the park” event hosted by UTRGV Athletics, pets for personal companionship will not be allowed in the Stadium. As a reminder, the failure to unreasonably provide necessary food, water, care, or shelter for an animal in a person’s custody may be a violation of Texas Penal Code.
- Failure to comply with UTRGV tailgate policies, Athletics Department or other UTRGV officials, stadium operations personnel, or law enforcement may result in revocation of tailgating privileges.
- Disruptive behavior, disorderly conduct, threats to engage in unlawful activity, public drunkenness, or similar types of behavior may result in referral to UTRGV for administrative review and potential discipline, early termination of seating or suite agreements with UTRGV, or possibly criminal prosecution.
- Attendees under the age of 21 consuming alcoholic beverages, those supplying alcohol to minors, or those who engage in any action prohibited by UTRGV policy, state, or federal law related to alcohol consumption and distribution may be subject to disciplinary or criminal action in accordance with applicable UTRGV policies or state or federal law.
Non-Football or Baseball Tailgating Policies
UTRGV Athletics is excited to offer fans the opportunity to tailgate during select games/events. Please follow the policies below to ensure a safe and enjoyable tailgating experience:
- One tailgate setup per parking space to include vehicle and canopies.
- Spaces are available on a first-come, first-served basis.
- Tailgating should take place within 4 feet in front of or behind your vehicle.
- All tailgaters who have a grill are required to bring a Class 3B fire extinguisher that is sufficiently charged.
- Kegs, beer balls, and other common-source containers are prohibited on campus and in tailgating areas. This includes beer funnels.
- Glass containers are prohibited.
- Food and beverages shall be for personal consumption only. Sales are prohibited.
- Amplified music must be confined to individual tailgate areas and speakers must be directed into the individual tailgate area.
- Hooking into, connecting to, or similar use of university utilities and/or television or communication cable services is prohibited.
- Saving parking spots is prohibited; to park together, guests must arrive together.
- Individuals may not erect or move barricades, barrels, fencing, or any other traffic control devices.
- All parking signs and instructions must be obeyed and strictly followed.
- Individuals are responsible for properly securing overhead objects (flags, balloons, etc.).
- It is the responsibility of each tailgate party to secure tailgating items prior to entering the stadium.
- Use of ATVs, golf carts, gators, scooters, mopeds, and other motorized recreational vehicles are prohibited.
- All trash from tailgates must be disposed of properly in designated containers.
- Restroom access will be available in or near the parking lot.
Baseball Corrals
All corral ticket holders must exit the corrals area no later than 15 minutes after the conclusion of the game.
Corral holders are allowed to bring in outdoor/patio style furniture. These items can be kept in the personal corral area for the duration of the season. UTRGV Athletics is not responsible for any lost or damaged items. All items must be cleared of corrals area at the end of the season.
Fans are permitted to bring food and beverages into the corrals in coolers or disposable bags. All coolers, bags, or containers that contain food and beverages must remain in the corrals area and will not be allowed in the regular seating bowl. UTRGV Athletics will inspect all coolers, bags, or containers upon entry to prevent the any prohibited items from entering the stadium.
Kegs, beer balls, and other common-source containers are prohibited on campus and in the corrals area. This includes beer funnels.
Amplified music of any kind is not allowed. Glass containers are prohibited. The sale of food and beverages is prohibited.
All trash must be disposed of properly in designated containers. Coal must be disposed of properly in designated coal containers.
